These Terms of Service ("Terms") govern your access to and use of the Agenda Custom website and the purchase of custom digital PDF downloads (the "Services"). By accessing or using the Services, you agree to these Terms.

Eligibility
You must be the age of majority where you live to use the Services. If you are under the age of majority, you may use the Services only with the consent and supervision of a parent or legal guardian.
Accounts
If we offer accounts, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
Purchases and Delivery
- The Services provide custom digital PDF downloads.
- After payment, we deliver your purchase via download link or email.
- You are responsible for storing and backing up your files.
License and Ownership
- We own all intellectual property in the Services and the materials we provide, except for content you submit.
- Subject to these Terms and your payment, we grant you a limited, non-exclusive, non-transferable license to use your purchased PDF for your personal or internal business use.
- You may not resell, redistribute, or publicly share the PDF unless we explicitly allow it in writing.
Your Content
- You retain ownership of the content you submit to create your custom PDF.
- You grant us a limited license to use your content to provide and improve the Services.
- You represent that you have all rights needed to submit the content and that it does not infringe third-party rights.
Prohibited Use
You may not:
- Use the Services for any unlawful purpose.
- Interfere with or disrupt the Services.
- Attempt to access systems or data without authorization.
- Reverse engineer, copy, or exploit the Services except as permitted by law.
- Use the Services to infringe intellectual property rights.
Payments, Taxes, and Billing
Payments are processed by Stripe. Prices are listed at checkout and may include applicable taxes. You authorize us and Stripe to charge your payment method for the amount shown at checkout.
Refunds
Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.
Print-Ready Guarantee
For eligible paid exports, if a print provider rejects your file due to an Agenda Custom export/output defect, we will attempt to provide a corrected file within 24 hours. If we cannot, you may be eligible for a refund under the Refund Policy.
Third-Party Services
The Services may rely on third-party services such as payment processors or analytics providers. Your use of those services is subject to their terms and policies.
Disclaimers
- The Services are provided on an "as is" and "as available" basis.
- We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not provide legal, financial, or professional advice. You are responsible for how you use the content we provide.
Limitation of Liability
To the fullest extent permitted by law, Agenda Custom will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to the Services. Our total liability for any claim will not exceed the amount you paid to us for the Services in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply to you.
Indemnification
You agree to indemnify and hold Agenda Custom harmless from any claims, damages, liabilities, and expenses arising from your use of the Services, your content, or your violation of these Terms.
Termination
We may suspend or terminate your access to the Services if you violate these Terms or if we discontinue the Services. Sections intended to survive termination will do so.
Governing Law and Venue
These Terms are governed by the laws of Alberta, Canada, without regard to conflict of laws principles. Any disputes will be brought in the courts located in Alberta, Canada, unless applicable consumer protection laws require otherwise.
